Legal Secondary Suites in Calgary (2026): Rules, Registry, Costs and What Changed in August
Updated November 2, 2026 · Written by Justin Warthe, Team Lead, The Top Calgary Real Estate Team
A basement suite can add several hundred dollars a month to a Calgary buyer's budget on paper, and it can also be the reason a lender says no, an insurer walks away or a buyer later discovers the suite has to be gutted. The difference is whether the suite is legal. Here is what a legal secondary suite means in Calgary in 2026, how to check one, what it takes to build or legalize one, and what the August 2026 zoning changes did and did not change.
Quick answer: In Calgary a legal secondary suite is one that has a building permit, meets the Alberta Building Code and Fire Code requirements for a suite, has passed inspection and is listed on the City of Calgary's Secondary Suite Registry. Since the repeal of citywide rezoning took effect on August 4, 2026, secondary suites are a permitted use in all of Calgary's low-density residential districts under Bylaw 26P2026, so the zoning question is usually settled; what remains is the permit, the inspection and the registry. Check any address on the City's registry before you pay a premium for a suite, and talk to your lender about how rental income from a legal suite counts toward qualifying.
Key takeaways
- Legal means permitted, inspected and registered. A suite that was built without permits is listed on MLS® as an illegal suite, and the City can order it removed or brought up to code.
- The repeal of blanket rezoning took effect August 4, 2026 and returned most parcels to their previous low-density districts, but council kept secondary suites as a permitted use in all low-density districts, so a suite is allowed in R-C1, R-C2 and the other reinstated districts without a land use change.
- Typical code requirements: a separate entrance, egress windows in bedrooms, interconnected smoke and carbon monoxide alarms, fire separation between the suite and the main home, adequate ceiling height and ventilation, and heating that meets code.
- Lenders and insurers treat legal and illegal suites differently. Many lenders will count a portion of legal suite rent toward qualifying; most will not count income from an illegal suite, and some insurers will not cover one.
Legal, illegal and the registry
Calgary's MLS® system requires listings to identify a suite as legal or illegal, and the City maintains a public Secondary Suite Registry of suites that have passed inspection. If a listing says "suite, legal" the address should be on the registry; if it is not, ask why. If a listing says "suite, illegal" the price should reflect that the suite may need permits, upgrades or removal, and your lender will likely ignore the rental income. A third category, the non-conforming suite built decades ago, still needs to meet current safety requirements to be registered. We check the registry for every suited home our buyers consider and we price suited homes we list accordingly.
What changed on August 4, 2026
In 2024 council rezoned most of the city to R-CG, which allowed rowhouses and suites on most lots. After the October 2025 election the new council voted to repeal that citywide rezoning, with the repeal approved in April 2026 and taking effect on August 4, 2026. Most parcels returned to their previous districts such as R-C1 and R-C2, and properties with approved R-CG, R-G or H-GO permits kept their zoning. Importantly for suite owners and buyers, council passed Bylaw 26P2026 making secondary suites a permitted use in all low-density residential districts, so a basement suite does not need a rezoning anywhere in the city. Backyard suites (garage or laneway suites) are permitted in R-G and discretionary elsewhere, and the rules on parking and on having both a secondary and a backyard suite on one lot reverted to the earlier standards; confirm the current rules for a specific lot through the City's land use tool.
Building or legalizing a suite
- Confirm the lot's district at calgary.ca/zones and whether a backyard suite, if that is the plan, is permitted or discretionary.
- Apply for a building permit with drawings that show the suite's layout, exits, windows, fire separation and mechanical systems; a development permit is generally not needed for a secondary suite in a low-density district, but it is for most backyard suites.
- Build to code: egress windows in every bedroom, a separate entrance, interconnected smoke and CO alarms in both the suite and the main home, fire-rated separation (drywall assemblies and doors) between the two units, adequate ceiling height, ventilation and a heating system that complies.
- Pass inspections at each stage and the final inspection.
- Register the suite on the City's registry, which gives you the public listing and the sticker that lenders, insurers and future buyers look for.
Legalizing an existing suite follows the same path. Common upgrades are egress windows, fire separation, alarms and electrical. Budgets vary widely with the condition of the basement; get quotes from contractors experienced with Calgary suite permits before you buy a home on the assumption that legalizing will be cheap.
What a legal suite does to value and financing
In the current market a legal suite is a genuine advantage: buyers under pressure from higher rates (the Bank of Canada raised its policy rate to 2.5% on October 28, 2026) look for help with the payment, and many lenders will add a portion of documented rent from a legal suite to qualifying income. Investors pay for the cash flow and the lower risk. For sellers, a registered suite is a marketing asset; an unregistered one is a negotiating point for the other side. Either way, confirm the registry status and keep the permits and inspection records with the home's documents.

Frequently asked questions
How do I know if a Calgary suite is legal?
Check the address on the City of Calgary's Secondary Suite Registry. A legal suite has a building permit, has passed inspection and is registered. MLS® listings must identify a suite as legal or illegal.
Are secondary suites allowed everywhere in Calgary after the rezoning repeal?
Yes in low-density residential districts. The repeal of citywide rezoning took effect August 4, 2026, and council made secondary suites a permitted use in all low-density districts under Bylaw 26P2026. Backyard suites are permitted in R-G and discretionary in other districts; confirm a specific lot with the City's land use tool.
What does a suite need to be legal in Calgary?
A building permit, construction to the Alberta Building and Fire Codes (separate entrance, bedroom egress windows, interconnected smoke and carbon monoxide alarms, fire separation, adequate ceiling height, ventilation and heating), passed inspections, and registration on the City's registry.
Can I use suite rental income to qualify for a mortgage?
Many lenders will count a portion of documented rent from a legal suite toward qualifying income; most will not count income from an illegal suite. Ask a mortgage professional about your lender's policy; we are not mortgage advisors.
How much does it cost to legalize a basement suite in Calgary?
It depends entirely on the existing basement. Typical upgrades are egress windows, fire separation, interconnected alarms and electrical work. Get quotes from contractors experienced with Calgary suite permits before you buy on the assumption that legalizing will be inexpensive.
